TCS denies allegations of falsifying visa requirements

Following allegations of trying to work around US visa norms, Tata Consultancy Services (TCS) said its strongly denies all accusations made by former employees as grouses of “disgruntled” employees.

Three former TCS employees recently filed lawsuits against the company under the federal False Claims Act, claiming that TCS misused L-1A manager visas to hire frontline workers without managerial duties, said reports. L-1 visa is a non-immigrant visa that is valid for three months to five years, as opposed to an H-1B that are valid for three to six years. Further, L-1 restrictions do not have pay restrictions.

“TCS does not comment on ongoing litigation, however, we strongly refute these inaccurate allegations by former employees, which have previously been dismissed by multiple courts. TCS rigorously adheres to all US laws,” said the company in its official statement.

While all three lawsuits were dismissed before trial, one of the ex-employees, Anil Kini, has appealed, claiming that TCS officials told him to falsify internal organisational charts to appear more manager-heavy, in line with the visa requirements., said reports
